Britain's Angry Wives Target Bonuses in Divorce Cases (Update1)
Posted Thursday, January 25, 2007 12:45:32 PM by Blog57 Team
Jan. 25 (Bloomberg) -- London bankers are celebrating a record 8.8 billion pound ($17.4 billion) year-end bonus pool. Thanks to a court ruling on future bonuses, spouses and their divorce lawyers may have the last laugh. The judgment involving an antique dealer and his wife may let ex-wives claim a portion of payouts awarded long after a breakup, burnishing London's reputation as a top venue for big-money divorce settlements. Legal experts say that a divorce hearing now before the High Court cites the case, Rossi v. Rossi, as a precedent for a bonus claim. The climate is so favorable to ex-wives that divorce lawyer Jeremy Levison advises bankers and hedge fund executives to avoid the altar altogether. Pre-nuptial agreements offer little protection because U.K....

Cara L. Smith TAX TIPS: Exemption hinges on custody time
Posted Sunday, December 24, 2006 2:45:43 PM by Blog57 Team
Q. My divorce degree lets my ex-husband claim one of our two children on his tax return even though they both live with me. Since my ex-husband is behind on paying child support, can I claim both children? A. Being behind on child support payments does not typically affect the right to claim a dependency exemption for a child. With divorced taxpayers, the general rule is that the parent with custody of the child for the greater part of the year receives the dependency exemption as long as the child does not provide more than one-half of his or her own support. If a child spends an equal amount of time with each parent, the parent with the higher adjusted gross income will receive the dependency exemption. Of course, there are exceptions to this general rule....

McCartney: Dignity Through Divorce

When it comes to airing details of his divorce, Paul McCartney wants to let it be—even if the media won't. Despite the increasingly damning claims leveled against the former Beatle by his estranged wife Heather Mills McCartney, the legendary singer says he doesn't hold any grudges against his ex-missus and will continue to conduct himself with "a certain dignity." "There are certain things in life that are personal, and I think a relationship with a partner is intensely personal, and I prefer to keep it that way," he told BBC Radio 4's Today show Friday. "When you are going through difficulties, I think the thing to do for the sake of all the people all concerned is to keep a certain dignity and remember that it is a private affair, and that way, you will probably get through it better....

Former Beatle's Wife Suing Newspapers Over Divorce Stories
Posted Sunday, October 29, 2006 2:46:10 PM by Blog57 Team
LONDON (AP) -- Heather Mills McCartney's lawyers said Tuesday she is suing two newspapers over "false, damaging and immensely upsetting" stories surrounding her divorce from Paul McCartney. The law firm Mishcon de Reya named the Daily Mail and London's Evening Standard as the subject of legal proceedings, adding that a suit will also be filed against The Sun. Mills McCartney had been vilified in the media and was now being stalked by photographers, the firm said. It alleged that other newspapers had also printed false statements but the three listed would be the focus of the lawsuit. "She cannot sue - for now, at least - every single newspaper that has published false, damaging, and immensely upsetting statements about her. She should not thereby be taken to have accepted that these statements are true," the statement read....

New 'collaborative law' divorce scheme

MARK COLVIN: London's tabloids are having a field day with allegations that Paul McCartney is a drug-taking, violent drunk, allegations that have come out largely because Britain does not have a no-fault divorce system. Australia does, and now there are moves to make it even less confrontational. Under a scheme called "collaborative law", a lawyer first signs a contract with the client, promising to settle the divorce without going to court. Crucially, if those talks fail and the divorce proceeds to court, the clients have to sack their lawyers. They're barred from using those same solicitors in a court setting. Supporters say it forces all parties to come up with creative solutions, saving money and time. Sabra Lane reports....

Divorce can leave you less secure

QUESTION: When my husband and I divorced five years ago, our family assets totaled $500,000 and we agreed on a 50-50 division — or so I thought. I got the house and furniture ($150,000) minus the mortgage ($50,000). My husband kept his 401(k) and the bank accounts ($250,000). Because I had not worked outside the home for years and needed income, my lawyer suggested that I take the remaining $150,000 in stocks, real-estate partnerships and trusts that I was told would pay 10percent per year ($15,000) so I could have an ongoing income stream. My husband paid me alimony of $750 per month for four years. As it turns out, I have not been able to get a job and have been forced to sell some of my assets. I didn't want to sell the house but found the partnerships and trusts very difficult to unload....

The divorce of Ira A. Bloom and Zhanna Portnov had been finalized a year earlier, but the custody and visitation battles over their 8-year-old son, Sammy, seemed never-ending during the summer of 2005. Their ongoing litigation was rife with restraining orders, including three in which Portnov claimed Bloom had threatened to kill her. The last she obtained only days before her husband allegedly met with a confidential informant to orchestrate her murder. ....

Stronach named in Domi divorce

Liberal MP Belinda Stronach is being named as the ex-factor in a divorce application filed by Leanne Domi against her former Maple Leafs player husband Tie Domi. According to a published report, Domi believes her husband and Stronach have been involved in an "intimate sexual relationship" since he began working on her political campaign in January 2006. Stronach, who has been linked to several high profile leading men like Bill Clinton and Foreign Affairs Minister Peter Mackay, is referred to "many times" in the 20-page document filed in court last week, the report states. Family law lawyer Andrew Feldstein said it's rare for lawyers to plead adultery in divorce applications because of the ugly fallout, opting mostly to file on the grounds of living separately and apart for one year....

Jailed man, missing millions part of bizarre divorce saga

Slight, scholarly and enigmatic, H. Beatty Chadwick is doing this day what he has done for the past 4,093: He is sitting in a county jail outside Philadelphia. It is a place meant for run-of-the-mill crooks just passing through on their way to comparatively luxurious state prisons. Certainly not for anyone to stay 11 years -- not for the central figure in one of the most bizarre divorce battles in American history. It hinges on a charge of civil contempt designed to force Chadwick to turn over $2.5 million the courts say he hid overseas all those years ago. Except he won't. Or can't, depending on whom you believe. So Chadwick sits. "He's an anomaly," said his lawyer, Michael Malloy. "They don't know what to do with him." The case has produced an Everest of court papers, including two pleas to the U.S....
