RV Bought on eBay Couldn't Win 'Take-Home Exposure' Asbestos Case

Oakland, Calif., lawyer Simona Farrise isn't taking a jury verdict against her client in an asbestos trial as a setback, but rather as a warning shot across the bow of automakers. But her opponents say Farrise is simply grasping at straws in an attempt to put a favorable spin on an obvious loss. Jurors in Alameda County Superior Court found Thursday that DaimlerChrysler Corp. wasn't responsible for the asbestos-related illness 33-year-old Rebekah Price claims she developed through exposure to relatives who worked as auto mechanics. The jurors found DaimlerChrysler had negligently exposed Price to asbestos, but they decided the automaker's negligence wasn't a "substantial factor" in causing Price's problems. "Chrysler and the auto companies should obviously be quite concerned that you had a jury that said that their auto products exposed a home family member to asbestos -- someone who was not a direct user of the products," Farrise said Friday....

A Mississippi woman who says she got cancer after years of washing clothes that were covered with asbestos dust has won a settlement from four companies that she blames for her illness. Patsy Jean Bodkin is a retired cook who washed her father's and brother's work clothes for years. She says the clothes were covered in asbestos dust that ultimately made her sick. Now bedridden, Bodkin relies on oxygen and morphine. She was expected to travel from her nursing home in northern Mississippi to Atlanta Monday for trial, but last week the parties reached an out-of-court settlement. Attorneys say a second-hand exposure suit is unusual. Bodkin has settled with four companies, including Georgia-Pacific Corporation - whose corporate headquarters are in Atlanta - and two companies that made joint compounds: Kelly-Moore Paint Company Incorporated and Bondex International Incorporated....

Fund set up for area asbestos victims

As many as 2,000 Puget Sound-area residents suffering from asbestos-induced illness could be compensated under a settlement reached earlier this week with bankrupt building material maker Owens Corning, a Seattle attorney involved in the settlement said. This region's shipbuilding, aluminum smeltering and wood-product industries all heavily used asbestos, said the attorney, Matthew Bergman. "These industries employed thousands of workers in Washington state from the 1940s through the 1970s," he said. "As a result, Washington has the second-highest rate of asbestos-related cancer in the nation." To recover, claimants must be seriously ill from exposure to asbestos at a job site where Owens Corning's products were used. The spouses of people killed by exposure can also recover....

Rhode Island Rhapsody

When a state sues an industry -- think tobacco -- any settlement money typically goes directly to that state. But when Rhode Island dropped the DuPont Corporation from a lead paint lawsuit last year, after the defendant agreed to donate $12 million to charity, most of the money ended up at organizations based in Washington, D.C., and Boston. Which is why Rhode Island Attorney General Patrick Lynch has some explaining to do. Rhode Island's "public nuisance" lawsuit against DuPont and several other former lead paint companies predates General Lynch, but the decisions to continue the litigation and settle were entirely ... ....

Mesothelioma is a type of preventable cancer that is caused by inhaling the dust or particles of the deadly mineral Asbestos. The symptoms range from shortness of breath, chest pains, and persistent cough in the early stages to abdominal pain, swelling and tumors growing in the tissues that surround the heart and if left untreated could cause death within 24 months. It has a long latency period in that the symptoms of the disease can take many years to manifest, making both diagnosis and effective treatment very difficult. Therefore, people who worked with asbestos industry perhaps thirty or forty years ago are only now being diagnosed with this disease. Many employers and manufacturers knew about the dangers of asbestos when they exposed employees to this material, but deliberately kept quiet and as the effects of this exposure are coming to light, these companies are being forced to pay out millions to sufferers....
