How To Avoid The Patent Trap

Almost two years ago, IBM donated 500 software patents to the open source community, with a pledge that it would not enforce its license rights to the technologies. But the company remains fiercely protective of its vast portfolio of intellectual property, as Amazon.com learned last week when IBM filed a patent-infringement suit claiming the Internet retailer built its business using IBM-developed technology and processes. Welcome to the tortuous world of technology patents and IP, where community-minded vendors share original ideas manifest as software code one day--then bring the hammer down on suspected scofflaws the next. Over the past two months, Microsoft has released three internally developed technologies--related to Web services, its virtual hard disk format, and its Sender ID--with promises that they can be used by others in perpetuity....

Rehearing in Lipitor Appeal is Denied: The Federal Circuit Preserves Its Prior Decision
Posted Tuesday, October 24, 2006 6:46:01 AM by Blog57 Team
The Court of Appeals for the Federal Circuit has denied rehearing in the U.S. patent case involving Lipitor®. This ruling leaves unaltered the Court's August decision that Lipitor® will remain covered by Pfizer's basic patent in the U.S. until 2010. In one of the most economically significant patent cases of the last century, Connolly Bove Lodge & Hutz LLP served as lead counsel at both trial and on appeal and successfully sustained Pfizer's basic patent and its term extension to preserve Pfizer's exclusivity over Lipitor®. The Federal Circuit appeal was argued by Rudolf Hutz and the trial team consisted of Rudolf Hutz, Mary Bourke, Collins Seitz, Jr., Jeffrey Bove and William McShane. This win secures Lipitor®'s status as the world's best selling drug. This decision comes on the heels of a series of wins at the Federal Circuit Court of Appeals for Connolly Bove....

Calif. Shops Sue for 'Surf City' Rights

Two Santa Cruz, Calif., beachwear shop owners are going to court in an attempt to wipe out the city of Huntington Beach's trademark on the nickname "Surf City USA." Attorneys for the shop owners filed a lawsuit Thursday in response to Huntington Beach's demands that they stop selling T-shirts emblazoned with "Surf City USA" in a circular border around "Santa Cruz California." "This case is not about which city has the most legitimate claim to be called the true Surf City USA," said attorney Ted Herhold, who represents the owners of Shoreline Surf Shop and Noland's on the Wharf. "Rather, this is about the freedom of individuals and merchants to conduct their business free from spurious claims of trademark infringement." The Huntington Beach Conference and Visitors Bureau announced in May that it had secured a trademark giving it exclusive use of the "Surf City USA" brand name in ads and on clothing....

Posted Saturday, October 07, 2006 10:45:50 AM by Blog57 Team
The United States Patent and Trademark Office (PTO) has granted requests from a consumer group and public service patent attorneys to re-examine three overreaching patents on human embryonic stem cells held by the Wisconsin Alumni Research Foundation (WARF), the groups said today. The challenges were brought by the Foundation for Taxpayer and Consumer Rights (FTCR) and the Public Patent Foundation (PUBPAT) against WARF patents that are impeding scientific progress and driving vital stem cell research overseas. In granting the requests to re-examine the three WARF patents, the PTO found that there were "substantial questions" regarding their validity. "We're pleased the PTO has decided to re-examine these patents," said John M....

Selling a generic version of a drug under patent dispute is one tactic that generic companies have been using in the high stakes competition between generic drug manufacturers and major pharmaceutical companies. As with the case of Cephalon (Nasdaq: CEPH - News) earlier in the year, disputes over the length of time a patent grants drug exclusivity frequently get settled outside of court, but not always. ....
