It's getting tough to open a magazine, turn on the TV or watch a movie these days without being confronted by some desperate housewife with a crazy libido and great abs. As a cultural phenomenon, all the "hot mom" movement has lacked is a heated legal battle, and now it has one: Trouble is brewing over ownership of the very term "hot mom." Jessica Denay, a single mom from Los Angeles who has a celebrity following, is in a dispute with TV marketing firm Buzznation and Medicis, the manufacturer of the dermal filler Restylane, Botox's so-called sister product. The company is producing a reality-TV pilot that, Denay maintains, co-opts a brand she created. Medicis isn't fazed by her claims, calling them "unfounded" and "false," and sees this aging demographic as too good to pass up....

Commission: Branson name issue gives city a bad name

The Taney County Commission has decided to officially oppose the city of Bransons claim to own a trademark to the name Branson. Presiding Commissioner Chuck Pennel said that the commission has been spurred to take a more active role against the citys enforcing of its name after a letter was sent to a business located at the Taney County airport, informing the owner that the business name needed to be changed, which caused the president of a national organization to take notice and also take notice with the citys desire to reserve its name for businesses only located within the city limits. The citys desire to not let anyone else use the name Branson is getting national exposure, and its giving the city a bad name, Pennel said. The letter was sent to Branson Aircraft Repair by Lathrop & Gage, the law firm representing the city in the enforcing of the service mark of its name....

Earlier this year, the United States Patent and Trademark Office (USPTO) proposed a series of new rules to streamline the examination of patent applications. If adopted in their current form, the rules will significantly affect how applicants develop their patent portfolios. At the moment, it is unclear what the final rules will be. Furthermore, the USPTO has not specified when the new rules will go into effect, but has indicated that at least 30 days advance notice will be given. ....

Downtown hot dog eatery ordered to change its name

Franks for the memories, Hot Dogma. In the dog-eat-dog world of hot dog restaurants, the Pittsburgh location has decided to settle and change its name to Franktuary. The settlement ends 17 months of legal wrangling with a Miami Beach restaurant that made a federal case out of the Pittsburgh site's name. Dogma Grill has a trademark on the word "dogma" and its attorneys contended the similarity in names might confuse consumers. The settlement includes a small, undisclosed financial compensation and an agreement to drop the name Hot Dogma from its signs, Web site and merchandising. "Basically, we have to pretend that we never existed," said Megan Lindsey, 25, one of the co-owners of the 2-year-old business located Downtown in the Trinity Episcopal Cathedral on Oliver Avenue....

NEW YORK (AP) -- Richard Stern has been living a double life: prosecutor by day, YouTube star by night. For three years, the 28-year-old Stern worked as a prosecutor for the Miami-Dade State Attorney in Florida. But unbeknownst to his colleagues, Stern was known to thousands by his online alias, Lazydork. Usually wearing his trademark blue bathrobe, Lazydork raps, reviews movies, and guards the noncommercial sanctity of YouTube in his homemade video clips. A good measure of his popularity has come as a rival to lonelygirl15, the YouTube sensation recently revealed as a fictionalized production starring actress Jessica Rose. In his most popular video (more than 621,000 views) Stern rapped to lonelygirl15 that "Lazydork is better than you," and claimed he was "going to buy and sell you like Google stock." Other videos have included Lazydork pouring milk over himself in slow motion while Edith Piaf is played as the soundtrack, and an announcement that he was running for "President of YouTube," intoning: "Don't forget, this IS a popularity contest." Stern makes the videos with his 23-year-old girlfriend, Lauren Perlman, who does the filming and co-writes much of the material....

Man convicted in sewage dumping case

A Neeses septic tank service owner has been found guilty of four counts of causing or permitting pollution of the environment after his trucks were observed dumping sewage at unauthorized locations.Victor M. Williams, 49, of 448 Dragstrip Rd., Neeses, was sentenced Wednesday in Orangeburg County General Sessions Court to two years and $10,000, suspended to $3,000 and five years probation on each count. The sentences are to run consecutively.Circuit Court Judge Howard P. King, who presided over the case, stipulated that if Williams pays his fines early, his probation can be terminated after two years. The case was prosecuted by attorneys with the S.C. Attorney General's Office.Williams is the owner of Williams Plumbing and Septic Tank Service, also known as Orangeburg Septic Tank Service. His trucks were observed illegally dumping raw sewage at unauthorized locations on four occasions.During the day and a half of testimony, one witness, Charles Hudson, said he observed one of Williams' trucks dumping sewage in the woods along Dragstrip Road.“I was coming home from work (on Feb....
