Justice Minister Charnchai Likhitjitta said the ministry has studied the system and found it could be a key to ending conflicts in criminal cases in the restive region. ''Currently, Thailand uses the arbitration system only in civil cases and the ministry is studying to see if it is applicable to criminal cases, particularly in cases with a maximum penalty of five years' imprisonment,'' the minister said during a public forum organised by King Prajadhipok's Institute. The Canadian Union of Public Employees turned down the offer by government negotiators on Thursday, as the clock ticks down to a Nov. 1 strike deadline. "We think they're offering a process where they know we'll be doomed to fail," CUPE negotiator Wayne Thomas told CBC News. Thomas said binding arbitration isn't an option because the pension — the main outstanding issue — affects thousands of workers in four other unions. An arbitrator doesn't have the power to change the pension, he said. "There's no way we believe that an arbitrator would take authority over a plan like that that affects so many people when those aren't direct participants to the arbitration." The International Cycling Union appealed to world sport's highest court, and Switzerland-based CAS dismissed the BCU's decision and suspended Forde until December 2007. Forde was the first cyclist from the English-speaking Caribbean to win a world championships medal, a silver in the kieren at Anaheim in 2005.
