Judge OKs Wiccan Lawsuit Against VA

MADISON, Wis. -- A federal lawsuit filed by Wiccans against the U.S. Department of Veterans Affairs will proceed despite a request by the VA that it be put on hold for up to a year. The lawsuit accuses the VA of coming up with excuses for more than nine years to deny the Wiccan symbol on national cemetery grave markers of veterans who belong to that religion. Currently, 38 other religious symbols are recognized by the VA for gravestones. ....

Cosby lawsuit settled

A WOMAN WHO filed a civil lawsuit in federal district court here in March 2005 against entertainer Bill Cosby, alleging that he drugged and sexually assaulted her, has settled the case. The attorney for plaintiff Andrea Constand issued a brief statement yesterday stating that Constand and Cosby had "resolved their differences" and that no further statement would be issued by any of the parties or their representatives. Terms of the settlement were not disclosed. "We have an agreement, but that's all I can say," said Dolores Troiani, Constand's attorney. David Brokaw, a publicist for Cosby, declined comment. Constand, 33, who lives near Toronto, had accused Cosby, 69, of drugging and groping her at his Cheltenham Township mansion in January 2004. She waited a year before going to police....

Judge Dismisses Lawsuit In Mabus Divorce Case

JACKSON, Miss. -- A Hinds County judge has dismissed a lawsuit filed by Julie Hines, the former wife of ex-Gov. Ray Mabus, against a priest whom she accused of taping her admission of an affair. The lawsuit against Jerry McBride, who participated in the taping of a meeting between Julie and Ray Mabus, in which she admitted to an affair, had been scheduled for trial this month. Hines, who now uses her maiden name, has until Nov. 9 to appeal Circuit Judge Bobby DeLaughter's decision. ....

Lawsuit targets diocese panel

ALBANY -- A California priest is suing the Albany Diocese's mediation panel, alleging the agency set up to help victims of clergy sex abuse fraudulently claimed it was independent of the diocese. The Rev. Mark Jaufman is seeking $2 million in his federal court action filed this week on his behalf and that of other unnamed victims. The suit targets the Independent Mediation Assistance Program, or IMAP. ....

U.K. Court Throws Out Lawsuit Over Equatorial Guinea Coup Plot

Oct. 23 (Bloomberg) -- A U.K. court threw out a lawsuit against a group of businessmen and mercenaries who allegedly plotted to topple the government of Equatorial Guinea. Teodoro Obiang Nguema Mbasogo, the president of the oil-rich West African nation, was seeking more than $5 million in damages from the alleged coup supporters for disrupting energy production and delaying infrastructure works. The Court of Appeal in London today dismissed the claim, backing an earlier ruling. The case involve matters of ``sovereign authority'' that can't be adjudicated in the U.K., Justice Anthony Clarke, Master of the Rolls, wrote in the judgment. Losses related to the coup ``arose as a direct result of the government's decisions as to how to respond to the conspiracy.'' Prominent Britons including Mark Thatcher, the son of former U.K....

Sempra Settles Lawsuit

Sempra Energy has settled a lawsuit brought by the California Public Utilities Commission and state Attorney General Bill Lockyer related to service curtailments of certain industrial San Diego Gas & Electric natural gas customers in 2000-2001. Both the company and the government announced the settlement Oct. 13. Sempra said the after-tax cost of the settlement is less than $5 million and the settlement will not have a material effect on the companys 2006 earnings. The settlement requires Sempra to pay $5.7 million to SDG&E customers over two years. The utilities also agreed to pay the state $2 million to offset legal costs. Additionally, SDG&E will be given an option to purchase Sempra Generations 480-megawatt El Dorado Energy power plant in Boulder City, Nev. The settlement also ends two other utilities commission investigations....

Hundreds in Sandpoint meet over possible property-tax lawsuit

SANDPOINT, Idaho (AP) -- A meeting to consider filing a class action lawsuit against the state over higher property assessments drew nearly 400 landowners in northern Idaho, including Sen. Shawn Keough, R-Sandpoint. "I think this suit is a way to go," Keough said, the Bonner County Daily Bee reported. "Any communication you can make to us with evidence will help legislators work toward change." The group, Sensible Taxation of Property, is organizing support for the potential lawsuit. "We are all unanimous of what we want to do and that's to have a Bonner County Tea Party," said Art Lambert, a committee member for the group. "What we are attempting to do is overturn Idaho's property tax law, and it will be a monumental task." ....

IBM Asks Court to Dump Linux Lawsuit

IBM Corp. asked a federal judge to throw out The SCO Group Inc.'s $5 billion lawsuit, arguing the Utah company failed to show its intellectual property was misappropriated when Big Blue donated software code to the freely distributed Linux operating system. SCO shares tumbled just short of a 52-week low. IBM filed six motions asking U.S. District Judge Dale Kimball and Magistrate Brooke Wells to toss out the claims remaining after Wells struck down most of SCO's case months ago. "For years, SCO purported to have evidence that IBM took confidential source code ... from UNIX System V and 'dumped' it into Linux. However, SCO does not have any such evidence," IBM lawyers said in court papers filed Tuesday. The lawyers said any code IBM contributed was "homegrown IBM" work or from sources other than SCO....

Sigma-Aldrich Settles Enzo Lawsuit

Sigma-Aldrich Corp., a supplier of chemicals to research laboratories, on Tuesday said it settled a lawsuit by Enzo Biochem Inc., Enzo Life Sciences and Yale University for an undisclosed sum. The U.S. District Court for the Southern District of New York approved the settlement last week and dismissed with prejudice the claims of all parties. Terms were not disclosed. According to a filing with the Securities and Exchange Commission, Enzo alleged in the 2002 lawsuit that Sigma breached two distributorship agreements, violated trademark rights and infringed upon various patents. Sigma-Aldrich said the settlement "will not have a material adverse effect" on its financial condition, operating results or liquidity. Sigma-Aldrich shares fell 37 cents to $73.04 in morning trading on the Nasdaq....

Diddy Settles Lawsuit; Can't Use Moniker in UK

Sean 'Diddy' Combs has made an out-of-court settlement for $200,000 after being sued by a U.K. music producer also called Diddy. Combs has changed his name from Puff Daddy to P. Diddy to simply Diddy in 2005. However, British DJ Richard 'Diddy' Dearlove has been using the moniker for over 10 years. The settlement means Combs is banned from using the name Diddy in the United Kingdom. He has also been ordered to pay Dearlove's $182,000 court costs and $18,000 in damages. Dearlove says, "I suffered from a head injury in 2001, when Sean Combs changed his name to P. Diddy. I lost my sight for three years and couldn't work. I was all ready to go last year, then, in August, he changed his name to Diddy. I was gutted. I started getting emails from Puerto Rican girls asking if they could be in my video, and people were asking me to look at their clothing line." Dearlove made a name for himself with his remixes of classic songs including "Atomic" by Blondie....
