GlaxoSmithKline issues update on US patent litigation regarding Valtrex

GlaxoSmithKline has issued an update on US patent litigation regarding Valtrex (valacyclovir), an antiviral drug used for the treatment and suppression of genital herpes, herpes zoster (shingles), and cold sores. In May 2003, GSK filed a patent infringement suit in the US District Court of New Jersey against Ranbaxy alleging that its generic product would infringe GSK's basic "composition of matter" patent (4957924) for Valtrex, which expires in June 2009 (excluding paediatric exclusivity). No trial date has yet been set for this litigation. On February 1, 2007, Ranbaxy received FDA approval for its generic valacyclovir product, and notified GSK that it sought to market the product in the USA. GSK will apply to the court for a preliminary injunction prohibiting launch of this product pending completion of the lawsuit....

Slain racer's lawyer tells of vitriolic litigation with defendant

PASADENA, Calif. A lawyer who once represented slain racing legend Mickey Thompson testified today that a legal battle between his client and the former business partner now on trial for murder was the most vitriolic litigation he ever encountered Philip Bartenetti testified at the trial of Michael Goodwin, who is accused of having Thompson and his wife, Trudy, murdered over the soured business relationship nearly 19 years ago. Bartnetti said he advised Thompson the case was getting too costly for both sides. The lawyer was called to testify as part of a circumstantial case being presented against Goodwin. Thompson, who gained fame in numerous auto sports and set land speed records, merged his motorcycle racing business with Goodwin's but their association quickly soured and Thompson successfully sued him....

Alabama With Utilities in Pollution Case

Alabama will weigh in on the side of the utility industry Wednesday as the U.S. Supreme Court takes up long-awaited litigation that could impact pollution levels from power plants across the country, including four plants in central and southern Alabama. With Republican Gov. Bob Riley's backing, Alabama is among 11 states that filed a brief with the court supporting the defendant, North Carolina-based Duke Energy Corp., which was sued for upgrading plants without improving emissions controls. The case is one of many court battles over the Clean Air Act's New Source Review regulations, including one involving Alabama Power Co., a subsidiary of Southern Co. Under New Source Review, utilities and other major polluters must update aging power plants with stronger emissions controls when they make improvements that increase power generation....

The latest round in the Denton-Tarrant boundary battle leaves the overwhelming impression that any more legal wrangling will needlessly cost taxpayers in both counties. Despite several tries, Denton County commissioners have been unable to undo an appeals court ruling in Tarrant County's favor in a dispute about the location of the boundary between the neighboring jurisdictions. But earlier this year, Denton County claimed in court that Tarrant owes about $2 million in property taxes that Denton officials calculated as the portion of its bond debt owed by property owners in the 3,500-acre triangle at the heart of the boundary fight. In September, Tarrant County countered with its own request for sanctions against Denton for filing frivolous motions....

SYCAMORE - DeKalb County officials said this week that they are preparing for the likelihood of litigation by a Kansas-based American Indian tribe that wants to build a bingo parlor on 128 acres it purchased near Shabbona earlier this year.“The attorney for the tribe indicated to us that we should prepare a budget and get ready to go to trial," County Administrator Ray Bockman said Thursday, recounting a conversation he said he had with Sycamore attorney Jordan Gallagher last week after the county announced it had suspended negotiations with the Prairie Band Potawatomi Nation.Attempts to speak directly with Gallagher on Thursday and Friday were not successful, but in a voice mail message he left with the Chronicle Friday, Gallagher, who has been retained by the Mayetta, Kan.-based tribe, denied making the statement “Get ready for litigation or trial."He added, “I have never made that statement, certainly not to you or anybody else and I know the Potawatomi are working very hard at trying to avoid the expense for themselves and the people of DeKalb County for that expensive litigation, and they are continuing to talk with people in the county and they will continue to do that." Toshiba Corp., the world's second-biggest flash memory maker, said it will pay $288 million to Micron Technology Inc. to end patent litigation started by a company Micron bought in June. Lexar Media Inc. sued Tokyo-based Toshiba over NAND flash memory that stores large amounts of data in digital cameras and music players such as Apple Computer Inc.'s iPod. Toshiba will get some of Lexar's patent rights and license others. The accord ends a battle that included a $465.4 million jury verdict in a trade secrets case against Toshiba, to be retried on damages in California, and a U.S. International Trade Commission complaint seeking to block the importation of Toshiba products accused of infringing Lexar patents. San Jose's Tripath settles litigation

Tripath Technology Inc. said Monday it agreed to settle litigation with Langley Partners againsts its founder and Chief Executive Adya Tripathi and its former Chief Financial Officer David Eichler. San Jose-based Tripath (OTCBB:TRPH) said all claims against the company will be dropped in exchange for payment to Langley Partners of $40,000 and common stock that corresponds to $357,750 based on the closing bid price on the first trading day before court's order approving the stock transfer. ....
