| | | Still no verdict in the Noe case | | Posted Sunday, November 12, 2006 6:45:45 PM by Blog57 Team | | TOLEDO - Jurors deciding the fate of a coin dealer accused of stealing at least $2 million from a state investment deliberated Thursday for a second day without reaching a verdict. Tom Noe, a former Republican fundraiser, has pleaded not guilty to charges of theft, money laundering, forgery and corrupt activity. Jury deliberations are scheduled to resume Monday. The scandal surrounding the investment became a political liability for the GOP and was a factor in the party's loss of all but one of the statewide, nonjudicial offices up for election Tuesday. The Ohio Bureau of Workers' Compensation gave Noe $25 million in 1998, followed by another $25 million in 2001 to invest in rare coins. Prosecutors say Noe took some of the state's money to pay off business loans and live a lavish lifestyle.... | |

A five-man, seven-woman jury reached a verdict against Barngrover and Southeast Regional Pain Center in Muscogee County's State Court late Tuesday morning, after about four hours of deliberations that began on Monday. The case against Barngrover and the pain center stemmed from the July 2000 injection Connie Hins received for chronic back pain, said Atlanta-based defense attorney Trey Reese. "I felt good about it," said attorney Don W. Johnson, who represented Hins. "It was obviously a good-sized verdict." The suit alleged Barngrover was negligent in training and supervision, and that Peggy Holder, an advanced practice registered nurse, performed below standards when administering the injection.... | |

| | | Murder convict's request to set aside verdict is denied | | Posted Wednesday, October 18, 2006 6:45:34 AM by Blog57 Team | | Superior Court Associate Judge Juan T. Lizama yesterday denied a motion to set aside the guilty verdict filed by Francisco Aguon Pua, who was convicted of the 2002 murder of a poker attendant.Lizama ruled that there is sufficient evidence to support Pua's conviction of felony murder."A rational trier of fact could have found the essential elements of felony murder beyond a reasonable doubt. It is possible that one of these elements was the uncharged 'attempted robbery,'" the judge said, adding that he need not speculate as to the jury's thought process.Lizama cited the rule of the majority, which states "the inconsistent verdict shall stand."He said Pua need not have been convicted or even charged with the underlying felony, provided that the evidence supports a finding of felony murder on at least one of the statutory bases.Police and court records show that on the morning of May 22, 2002, the body of Mostofa Faruk Parves was found inside Candi's Poker in Tanapag with multiple stab wounds.... | |

| | | Calif. Judge Slashes $61 Million FedEx Verdict | | Posted Thursday, September 14, 2006 2:45:41 PM by Blog57 Team | | Calling an initial $61 million verdict "excessive," last week Alameda County Superior Court Judge Stephen Dombrink whittled down a jury award against national shipping company Federal Express and one of its managers to a modest $12.4 million. In his written decision, Dombrink stated concern that the evidence failed to support the initial verdict in an employment discrimination case. "The harassment was mostly just offensive name-calling," Dombrink noted in his Sept. 5 ruling. In June, the jury handed the $61 million award to two Lebanese-American FedEx drivers who accused a manager of racial discrimination and harassment. The verdict was thought to be the largest single civil rights judgment under California's Fair Employment and Housing Act and the fourth-largest verdict of any kind in Alameda County history.... | |
